Payments are to be made via the accepted methods specified in the agreement, including but not limited to bank transfers, credit card payments, or other agreed-upon methods. Payments are due by the last calendar day of each month, unless otherwise stated in the agreement. Late payments are subject to a fine for each day of delay, as outlined in the invoice or agreement. Continued non-payment may result in suspension of services, additional fines, or legal action.

Clients are responsible for covering any additional expenses that exceed the agreed-upon package limits. Examples include: Talent: If the package includes a standard model/actor/other talent, the client is responsible for covering the difference in cost if a celebrity or higher-priced talent is requested. Locations: Packages include studio locations with a maximum embedded fee. If a more expensive location is requested, the client must pay the additional costs. Equipment: Any specialized or higher-tier equipment requested by the client beyond what is included in the package must also be covered by the client. The Company is not liable for delays, cancellations, or additional costs resulting from these client-specific requests.

This includes, but is not limited to, business strategies, marketing plans, unpublished content, financial details, or any other materials marked or identified as confidential. These tools are utilized to enhance productivity, streamline processes, and ensure the best outcomes for our clients. By engaging with our services, you acknowledge and agree to the use of such third-party platforms as part of the service delivery process.

While we carefully select and collaborate with reputable third-party providers, 916MEDIA is not responsible for the functionality, performance, or availability of these external services. Any issues, delays, or disruptions caused by third-party platforms are beyond our control and liability. Additionally, all interactions or agreements between the client and third-party providers (e.g., models, external studios, or tools) are the sole responsibility of the client. Any disputes, costs, or liabilities arising from these relationships must be resolved directly with the third party involved.

Clients acknowledge that certain factors, such as market conditions, third-party platform changes, or audience behavior, are beyond our control and may impact the performance of the delivered services.

For clients on a monthly retainer, a minimum commitment of three months is required. After the initial three-month period, the agreement transitions to a month-to-month contract, which can be terminated with a 30-day written notice. If a client requests cancellation within less than 30 days of their next billing cycle, they remain obligated to pay for the upcoming month.

In cases where the agreement is terminated, any content provided by 916MEDIA that is subject to time-restricted usage must adhere to the agreed-upon guidelines. If the client continues using such content beyond the licensed period, they will be required to pay for extended usage rights as specified in the original agreement. Failure to comply with these terms may result in legal or financial consequences.

These Terms and Conditions, along with any disputes or claims arising from or related to their subject matter, shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of laws principles.
